How to get your NGO registered?

Non-Governmental Organisations or  NGOs, are becoming one of the best spaces in bringing people from different spheres together, to be and become a bridge between those who have and those who need. Whether as a communication link between people among themselves or between the people and the govt. NGOs play a vital role in society.

For NGOs to get proper aid, help, financial assistance, legal rights and recognition under the law, they are required to be registered.

As per section 12(1) of the National Trust Act, any voluntary organisation or the association of parents of persons with disabilities or the "Association of Persons with disabilities working in the field of autism, cerebral palsy, mental retardation and multiple disabilities" already registered under the Societies Registration Act, 1860(21 of 1860), or Section 25 of the Companies Act, 1956 (1 of 1956), or as a Public Charitable Trust and under Persons With Disability Act, 1995 in the concerned state can apply for registration in National Trust by filling online form along with form `E’ (generated by the system) duly signed and stamped by the President/General Secretary of the organisation.

The registration of such organization shall be necessary with the Trust for availing benefits under the schemes of the Trust.

We have following laws dealing with such registration

1. Societies Registration Act, 1860(21 of 1860),

2. Companies Act, 1956(1 of 1956),

3. Public Charitable Trust

4. Persons With Disability Act, 1995

Now, how to begin with registration?

Check the eligibility criteria for NGO registration

Check your eligibility, particularly under the National Trust Act and Persons with Disabilities Act. Before applying, get registered under the PWD Act if not already registered. The National Trust registration will be generally co-terminus with the registration under the PwD Act,1995.

  • Voluntary Organization / Association of Parents of Person with Disability / Association of Person with Disability working in the field of Autism, Cerebral Palsy, Mental Retardation, Multiple Disability can apply.

  • Should be registered under Societies Registration Act of 1860 or Section of 25 of Companies Act 1956 or as a Public Charitable Trust.

  • Should also be registered under Persons with Disability Act 1995.

Example:- If an Organisation gets registered under the National Trust Act on 1/1/2015 and its registration under the PwD Act, 1995, is valid till 31/12/2017, the organisation will be considered registered under the National Trust Act till 31/12/2017 only.

However, the organisation will be given a further period of six months to one year (grace period) for the submission of a valid certificate of registration under the Persons with Disabilities Act, 1995. If it is submitted within that period, the registration will remain valid for the balance period of registration with the National Trust.

Otherwise, the Registration under the National Trust Act will stand cancelled. In such a case, the Organisation has to apply afresh for registration under National Trust Act with full information and documents along with fee after getting duly registered under the PWD Act, 1995.

Fees :-

Registration Fees is Rs. 2000/- for urban & Rs. 1000/- for a rural area. The fee is to be deposited electronically.

Keep the following documents ready :-

1.       Resolution and authorisation of the organisation to file an application for registration.

2.       Form E for registration under Rule 27(3). All pages duly signed and stamped by an authorised signatory.

3.       Audited annual accounts of the last two years

4.       Annual Report of the last year

5.       Memorandum of Association (MOA)

6.       Certificate of Registration under Persons with Disabilities Act-1995.

7.       Certificate of Registration/ Incorporation under any relevant Act like Societies Registration Act.

It’s better to enclose all the documents with the online application to facilitate expeditious processing and avoid the delays in the  Indian administration.

Hard copy of all requisite documents, including duly signed and stamped Form E generated through online process must be submitted in the National Trust office within seven days of the online submission.

NGOs registered with The National Trust, are given a grace period of 6 months to one year for getting new registration under PWD Act when the registration expires..

Application for renewal of registration should be submitted to the National Trust six months prior to the expiry of the date of registration under the National Trust Act.

With the online link, the following easy steps are required to be followed:-

  “Login-> Registration-> Edit Registration Form”        

After paying the registration fees on Step 9, click the Submit button to move to the next level for verification.

After the 9th step Edit / Print / Submit, please get a print of the online form (to be sent to “The National Trust” along with the hard copies of other documents uploaded in the online form).

If you have opted for the RTGS / NEFT, download the Challan Form that appears on their screen and take that to the bank for payment and send the details to NT at contactus@thenationaltrust.in.
